The accused has been charged by the public prosecutor with having pushed the witness *** so hard from behind on November 30, 2003 at around 1.30 p.m. without justifying or excusing cause that she fell to the ground and sustained superficial abrasions.<\/p>\n\n
The defendant denied the offense. As a result, the court was not convinced during the main hearing after taking evidence that the defendant had committed an assault to the detriment of the witness ***. He was therefore acquitted on factual grounds with the consequence of costs pursuant to sections 465, 467 of the Code of Criminal Procedure. <\/p>\n\n
